1. Acceptance of Terms
By accessing or using the Online Exams platform ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
The Service is provided to educational institutions and their authorised users (administrators, lecturers, and students). Your use of the platform is also subject to any agreements between Online Exams and your institution.
2. Description of Service
Online Exams is a web-based platform that enables educational institutions to create, administer, and grade online examinations. The Service includes features such as question banks, timed exams, auto-grading, manual grading, security monitoring, and result management.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to institutional administrators.
3. User Accounts & Responsibilities
Account Creation — User accounts are created by institutional administrators. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
Accurate Information — You agree to provide and maintain accurate information associated with your account. Notify your institution's administrator immediately if you suspect unauthorised use of your account.
Acceptable Use — You agree to use the Service only for its intended educational purposes. You must not attempt to circumvent security measures, access other users' data, disrupt the Service, or use it for any unlawful purpose.
4. Academic Integrity
The Service includes security features designed to maintain academic integrity during examinations. By using the platform to take exams, you agree to:
• Not attempt to cheat, copy, or engage in dishonest conduct during exams
• Not use unauthorised materials, devices, or assistance during exams
• Not share exam content, questions, or answers with others
• Not attempt to bypass browser lockdown, copy-paste restrictions, or other security measures
• Accept that your exam activity may be monitored and logged for integrity purposes
Violations of academic integrity may result in consequences determined by your institution, including but not limited to exam invalidation or disciplinary action.
5. Intellectual Property
The Online Exams platform, including its design, code, features, and branding, is the intellectual property of Online Exams and is protected by applicable laws.
Exam content (questions, answers, and materials) uploaded by lecturers and institutions remains the intellectual property of the respective content creators or their institutions. Online Exams does not claim ownership of user-generated exam content.
You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written permission.
6. Exam Submissions & Data
When you submit an exam, your answers are recorded and stored securely. Submissions are final once the exam is submitted (either manually or by auto-submission when time expires).
Exam results, grades, and feedback are managed by your institution's lecturers and administrators. Online Exams processes this data on behalf of your institution.

7. Service Availability
We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We will make reasonable efforts to schedule planned maintenance outside peak exam periods and to notify institutional administrators in advance.
8. Limitation of Liability
To the maximum extent permitted by law, Online Exams shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
This includes, without limitation, damages for loss of data, loss of grades, exam disruptions due to technical issues, or inability to access the Service. Our total liability for any claim shall not exceed the fees paid by your institution for the Service in the twelve months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Online Exams, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any applicable law.
10. Termination
Your access to the Service is tied to your institution's agreement with Online Exams. Individual user accounts may be terminated by institutional administrators at any time.
We reserve the right to suspend or terminate access for any user who violates these Terms, engages in academic dishonesty, or poses a security risk to the platform.
11. Changes to These Terms
We may update these Terms from time to time. We will notify institutional administrators of material changes and update the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
